Who Qualifies
- A female SSS member — employed, self-employed, voluntary, OFW or a separated member — with at least 3 monthly contributions in the 12-month period immediately before the semester of contingency (RA 11199, Sec. 14-A).
- The benefit is paid for every pregnancy, miscarriage or emergency termination; the old four-delivery limit no longer applies (RA 11210).
- SSS must be notified of the pregnancy in advance (Maternity Notification) — through your employer if employed, or directly through My.SSS otherwise.
Salary Differential From Your Employer
Under RA 11210, Sec. 5 the employer of a member in the private sector pays the difference between her full salary for the leave period and the SSS maternity benefit, so that she receives full pay for the 105 days. Exempt employers: distressed establishments, retail and service establishments with not more than ten workers, micro-business enterprises with total assets of ₱3 million or below, and those already giving an equal or better benefit under a collective bargaining agreement or company policy. The employer must also advance the SSS benefit within 30 days of the leave application and claims reimbursement from SSS.
Leave Days and Options
- 105 days with full pay for every live birth, normal or caesarean; 30 more days may be added without pay on written notice to the employer at least 45 days before the leave ends.
- 120 days for a solo parent qualified under RA 8972.
- 60 days for a miscarriage or emergency termination of pregnancy.
- Up to seven days may be allocated to the child’s father (on top of his paternity leave) or, if the mother is single, to an alternate caregiver.

A ₱20,000 salary maps to a ₱20,000.00 MSC. Six months of it total ₱120,000.00; ÷ 180 gives ₱666.67 a day; × 105 days = ₱70,000.00 for a normal or caesarean live birth. A solo parent gets ₱80,000.00 (120 days); a miscarriage pays ₱40,000.00 (60 days).
What is the maximum SSS maternity benefit in 2026?
Benefits are computed on the MSC only up to ₱20,000.00 — the Regular SS cap in RA 11199, Sec. 8(g), restated in SSS Circular 2024-006 — even though contributions run up to ₱35,000.00 (the excess is MPF savings). The highest possible benefit is therefore ₱120,000.00 ÷ 180 = ₱666.67 a day × 105 days = ₱70,000.00 for a live birth, or ₱80,000.00 for a solo parent with 120 days.
What is the “semester of contingency”?
A quarter is three months ending in March, June, September or December; a semester is two consecutive quarters ending in the quarter of contingency (RA 11199, Sec. 8(o)–(p)). Example from SSS: a birth in October 2021 makes July–December 2021 the semester of contingency, so the 12 months counted are July 2020 to June 2021. SSS requires at least three posted contributions within those 12 months and takes your six highest MSCs from them; contributions paid within or after the semester are ignored.
How many days of maternity leave are paid?
105 days for every live birth regardless of delivery type, with an option to extend 30 more days without pay; 120 days if you qualify as a solo parent under RA 8972; 60 days for a miscarriage or emergency termination of pregnancy (RA 11210, Sec. 3). Up to seven of the 105 days may be transferred to the child’s father or an alternate caregiver.
Does my employer pay anything on top of the SSS benefit?
Yes, if you are employed in the private sector. RA 11210, Sec. 5(c) requires the employer to pay the salary differential — the gap between your full pay for the leave period and the SSS cash benefit — unless the employer is exempt: distressed establishments, retail or service establishments with not more than ten workers, micro-business enterprises with total assets of ₱3 million or below, or employers already giving an equal or better benefit. Exemptions need DOLE approval every year. The employer advances the SSS benefit within 30 days of your leave application and SSS reimburses it.
Can voluntary, self-employed or OFW members claim the maternity benefit?
Yes. Any female member with at least three posted monthly contributions in the 12 months before the semester of contingency qualifies, whatever her membership type. Self-employed, voluntary and OFW members file directly with SSS and receive the benefit themselves; there is no employer salary differential for them.
How do I file for the SSS maternity benefit?
Notify your employer of the pregnancy and probable delivery date if employed (the employer files the Maternity Notification with SSS), or notify SSS directly through My.SSS if you are self-employed, voluntary, a non-working spouse or an OFW. After delivery, file the Maternity Benefit Application with the child’s birth certificate (or the medical records for a miscarriage). Employed members receive the advance from their employer; others are paid to their enrolled disbursement account. One benefit is paid per delivery even for twins; overlapping claims are paid consecutively with the overlap deducted.
