What the Household Pays Each Month

Premiums for a kasambahay paid at each regional minimum, using the SSS household-employer schedule (Circular 2024-007), PhilHealth’s 5% on the ₱10,000 income floor split 50/50, and Pag-IBIG 2% each. The employer’s SSS share includes the ₱10 Employees’ Compensation premium.

The ₱5,000 rule: RA 10361 Sec. 30: SSS, PhilHealth and Pag-IBIG premiums are shouldered by the employer; a kasambahay earning ₱5,000 a month and above pays the proportionate share. Same threshold in SSS Circular 2024-007 (household schedule, January 2025), PhilHealth Circular 2020-0005 and HDMF Circular 460 Item C.1.5. Register the kasambahay within 30 days of hiring through the Kasambahay Unified Registration System — one form at SSS, PhilHealth or Pag-IBIG produces all three numbers (SSS Household Employers). Late or unremitted SSS contributions carry a 2% monthly penalty.

Kasambahay Benefits Under RA 10361

  • 13th month pay after 1 month of service: at least 1/12 of the year’s basic salary, by December 24 or on separation (Sec. 25; IRR Rule IV Sec. 8). See the 13th month pay calculator.
  • Service incentive leave: 5 days with pay after 1 year of service. Unused leave is not carried over and cannot be converted to cash (Sec. 29) — unlike the Labor Code SIL of other workers.
  • Rest: an aggregate daily rest of 8 hours (Sec. 20) and at least 24 consecutive hours of rest a week, scheduled by written agreement (Sec. 21). The law sets no 8-hour workday for adult kasambahay.
  • Board and lodging: at least three adequate meals a day and humane sleeping arrangements, which the employer may not withhold as punishment (Sec. 6).
  • Pay: in cash at least once a month, with a pay slip every payday that the employer keeps for three years (Secs. 25–26). No vouchers, tokens or promissory notes.
  • Social protection: SSS, PhilHealth and Pag-IBIG after 1 month of service (Sec. 30), plus Employees’ Compensation.
  • Deductions: no deposits for loss or damage (Sec. 14); loan repayments and proven loss or damage may be deducted only with written consent and up to 20% of the monthly wage (IRR Rule IV Sec. 11, Rule V Sec. 6).

Holiday Pay, Overtime and Night Differential

These Labor Code benefits do not apply to kasambahay: Article 82 excludes domestic helpers from the rules on hours of work, overtime, night shift differential, weekly rest, holiday pay and service incentive leave, and the DOLE Handbook on Workers’ Statutory Monetary Benefits (2024) lists kasambahay among those not covered. A household may agree to pay extra for extra hours or holiday work — RA 10361 Sec. 11 requires the contract to state the hours of work and any proportionate additional payment.

Contract, Registration and Termination

  • Written contract before work starts, in a language both understand, covering duties, pay, hours, rest days, board and lodging and termination (Sec. 11). DOLE’s standard form is BK-1; NWPC hosts a sample contract.
  • Barangay registration: the employer registers every kasambahay in the Registry of Domestic Workers of the barangay where the household lives (Sec. 17).
  • Minimum age: 15. Working children aged 15–17 get the full minimum wage and benefits but may not work more than 8 hours a day or 40 hours a week, or between 10 p.m. and 6 a.m. (Sec. 16; IRR Rule VI).
  • Ending the job: with no fixed term, either side may give 5 days’ notice (Sec. 32). A kasambahay dismissed without just cause gets the pay already earned plus 15 days’ pay; one who leaves without just cause forfeits up to 15 days of unpaid wages. Pregnancy and marriage are not valid grounds for dismissal (IRR Rule VII Sec. 4).
  • Penalties: fines of ₱10,000.00 to ₱40,000.00 for unlawful acts such as withholding wages or hiring a child under 15 (Sec. 40). Disputes go to the DOLE Regional Office for conciliation first (Sec. 37).

Frequently Asked Questions

How much is the kasambahay minimum wage in 2026?

₱7,800.00 a month in Metro Manila under Wage Order NCR-DW-06 (since February 7, 2026). Outside NCR it runs from ₱5,500.00 (BARMM) to ₱7,500.00 (Region VII). Each regional wage board sets its own monthly rate, and domestic-worker orders allow no exemptions.

Who pays the SSS, PhilHealth and Pag-IBIG of a kasambahay?

Both share them once the kasambahay earns ₱5,000.00 a month or more; below that the employer pays everything (RA 10361, Sec. 30). Every regional minimum is now above ₱5,000.00, so a kasambahay paid at least the minimum pays the employee share. Coverage starts after 1 month of service, and the employer registers the kasambahay with all three agencies.

How much SSS do I pay for my kasambahay?

At the NCR minimum of ₱7,800.00, the SSS credit is ₱8,000.00: the employer pays ₱810.00 (10% plus the ₱10 EC) and the kasambahay ₱400.00 (5%). With PhilHealth (₱250.00 each) and Pag-IBIG (₱156.00 each), the employer adds ₱1,216.00 a month and the kasambahay takes home ₱6,994.00.

Do kasambahay get 13th month pay?

Yes. After at least 1 month of service a kasambahay is owed 13th month pay of at least 1/12 of the basic salary earned in the year, paid by December 24 or on separation (RA 10361, Sec. 25; IRR Rule IV Sec. 8). PD 851 itself leaves out household employers, but RA 10361 grants it anyway.

Do kasambahay get holiday pay or overtime pay?

No. The Labor Code rules on hours of work, overtime, night shift differential, holiday pay and premium pay do not cover domestic helpers (Labor Code Art. 82; DOLE Handbook 2024). Kasambahay instead get an 8-hour daily rest, a 24-hour weekly rest day and 5 days of paid leave a year under RA 10361. Extra pay for extra hours applies only if the written contract provides it.

Can I deduct food and lodging from my kasambahay’s salary?

No. Three adequate meals a day and humane sleeping arrangements are the employer’s duty (RA 10361, Sec. 6), wages may not be cut by deductions the law does not mandate unless the kasambahay consents in writing (Sec. 25), and the regional domestic-worker wage orders state that no deductions other than those mandated by law may be made. Requiring a deposit to cover loss or damage is unlawful (Sec. 14).

Is a family driver a kasambahay?

No. The IRR of RA 10361 (Rule I Sec. 2) excludes family drivers, service providers, children under foster family arrangement and people who work only occasionally. Source: IRR of RA 10361.

Magkano ang minimum na sahod ng kasambahay sa Metro Manila?

₱7,800.00 kada buwan (Wage Order NCR-DW-06, simula February 7, 2026).

What is the kasambahay minimum wage in Cebu (Central Visayas)?

₱7,500.00 a month under Wage Order ROVII-DW-06, in effect since October 14, 2026. The Region VII order also covers Negros Oriental and Siquijor.
