Service Incentive Leave (SIL) Calculator and Leave Benefits
Every employee with at least one year of service gets 5 days of service incentive leave with pay a year (Labor Code Art. 95). Unused SIL is converted to cash at year-end or when you leave, at your daily rate on that date, pro rata. In DOLE's example, an employee hired January 1, 2023 who resigned March 1, 2024 at ₱610.00 a day is owed 5.833 days, or ₱3,558.13. Other paid leaves: 105-day maternity, 7-day paternity, 7-day solo parent, 10-day VAWC and up to 2 months' special leave for women.

How Service Incentive Leave Is Converted to Cash
- Check entitlement: at least 12 months of service, continuous or broken, counting authorized absences, unworked rest days and paid regular holidays.
- Count unused days: 5 days per year of service, pro-rated for part of a year (months ÷ 12 × 5), minus days used or already converted.
- Multiply by the daily rate on the date of conversion. For monthly-paid employees, the daily rate is monthly salary × 12 ÷ the days paid per year — see the Daily Rate Calculator.
- On resignation or separation, the value of all unused SIL is paid with your final pay.
Who Is Not Entitled to SIL
- Government employees, including those of GOCCs with original charters
- Persons in the personal service of another
- Managerial employees (manage the establishment or a department, regularly direct two or more employees, and can hire or fire or effectively recommend it)
- Officers or members of a managerial staff meeting the Handbook's four conditions
- Field personnel and others whose time and performance are unsupervised
- Those already enjoying the benefit
- Those with vacation leave with pay of at least five days
- Those in establishments regularly employing fewer than ten employees

Frequently Asked Questions
How many days is service incentive leave in the Philippines?
Five days with pay every year, for every employee who has rendered at least one year of service (Labor Code Art. 95). "One year of service" means 12 months, continuous or broken, counted from the start date, including authorized absences, unworked rest days and paid regular holidays. SIL can be used for sickness, vacation or any other purpose.
Is service incentive leave convertible to cash?
Yes. Unused SIL can be converted to its money value at the end of the year, and any SIL neither used nor converted must be paid when you resign or are separated. The conversion uses your daily rate on the date of conversion and may be pro-rated (DOLE Handbook 2024, Ch. 7). Five unused days at ₱695.00 a day are worth ₱3,475.00.
How is SIL computed when I resign?
Count the SIL earned and not yet used or converted, including a pro-rated share of the current year, and multiply by your daily rate at separation. DOLE's example: an employee hired on January 1, 2023 who resigned on March 1, 2024 at ₱610.00 a day earned 5 days for 2023 plus 2/12 × 5 = 0.833 days for January–February 2024, a total of 5.833 days worth ₱3,558.13. It is part of your final pay.
Who is not entitled to service incentive leave?
Government employees, including those of GOCCs with original charters; Persons in the personal service of another; Managerial employees (manage the establishment or a department, regularly direct two or more employees, and can hire or fire or effectively recommend it); Officers or members of a managerial staff meeting the Handbook's four conditions; Field personnel and others whose time and performance are unsupervised; Those already enjoying the benefit; Those with vacation leave with pay of at least five days; Those in establishments regularly employing fewer than ten employees (DOLE Handbook 2024, Ch. 7).
Are vacation leave and sick leave required by law?
The only general paid leave in the Labor Code is the five-day SIL, which may be used as sick or vacation leave. Separate vacation and sick leave credits come from company policy, the employment contract or a collective bargaining agreement; an employer that already gives at least five days of paid vacation leave does not have to add SIL on top.
How many days is paternity leave in 2026?
7 days with full pay per delivery, for the first four deliveries (RA 8187). Who qualifies: Married, cohabiting with the wife, and applied within a reasonable time (no prior application needed for a miscarriage). Unused paternity leave is not converted to cash. A mother may also transfer up to 7 days of her maternity leave to the child's father under RA 11210, over and above his paternity leave.
How many days is solo parent leave?
Up to 7 working days with pay every year under RA 8972 as amended by RA 11861, the Expanded Solo Parents Welfare Act. Who qualifies: At least six months of service, notice to the employer, and a valid Solo Parent ID (SPIC) from the city or municipal social welfare office. It is on top of other leaves, not cumulative, and not convertible to cash unless the employer agreed to it.
What is the special leave for women under the Magna Carta of Women?
Up to 2 months (60 calendar days) a year with full pay, per the physician's certified recuperation period after surgery caused by a gynecological disorder, such as dilatation and curettage, hysterectomy, ovariectomy or mastectomy (RA 9710 (Magna Carta of Women)). Who qualifies: Six months' continuous aggregate service in the 12 months before surgery for a gynecological disorder, and an application within a reasonable time. The pay is based on gross monthly compensation — basic pay plus mandatory allowances.
Halimbawa: 5 araw × ₱695.00 = ₱3,475.00.
