Retirement Pay Calculator (RA 7641)
The minimum retirement pay under Article 302 of the Labor Code (RA 7641) is one-half month salary for every year of service, and "one-half month" means 22.5 days: 15 days' pay + 5 days of service incentive leave + 2.5 days for one-twelfth of the 13th month pay. So retirement pay = daily rate × 22.5 × years, with a fraction of 6 months or more counting as a year. It applies at 60 to 65 years old after at least 5 years' service. Example: ₱800 a day × 22.5 × 20 years = ₱360,000.00. This is separate from your SSS pension.

Coverage and Conditions
- Age: optional retirement from 60, compulsory at 65 (earlier for mineworkers and jockeys under their special laws).
- Service: at least 5 years with the establishment.
- Exempt employers: the government, and retail, service and agricultural establishments regularly employing not more than 10 employees.
- Salary base: the latest basic daily rate; COLA and other allowances are excluded unless the employer agrees or a CBA includes them.
- Company plans and CBAs: prevail when they pay more; the employer tops up when they pay less.
- Paid-by-results and part-time workers: use the average daily salary of the last 12 months; part-time workers get a proportionate amount.

How is retirement pay computed under RA 7641?

Who is entitled to retirement pay?
Private-sector employees who retire at 60 to 65 years old (optional from 60, compulsory at 65) after at least 5 years of service with the employer, when there is no retirement plan or the plan pays less than the RA 7641 minimum. Not covered: government employees and employees of retail, service and agricultural establishments regularly employing not more than 10 workers. Part-time workers are covered in proportion to their pay.
Is COLA included in the daily rate for retirement pay?
No. The DOLE Handbook states that the cost-of-living allowance is not included in the computation of retirement pay, and the courts exclude allowances from the salary base for retirement benefits (Cebu Institute of Technology v. Ople). Use the basic daily rate; a company plan or CBA may add more.
What if my company has its own retirement plan?
You get the plan or CBA benefit, provided it is not less than the RA 7641 minimum; if it is less, the employer pays the difference. Where both employer and employee contribute to a fund, the employer's contributions plus interest must at least equal the RA 7641 amount.
Do mineworkers and jockeys retire earlier?
Yes. Underground or surface mine employees may retire at 50 (optional) and 60 (compulsory) after five years of mine service under RA 8558 as amended by RA 10757; licensed racehorse jockeys retire compulsorily at 55 after five years (RA 10789).
Magkano ang retirement pay kung ₱20,000 ang buwanang sahod at 15 taon sa kompanya?
Kunin muna ang daily rate: ₱20,000 × 12 ÷ 313 = ₱766.77 kung anim na araw kada linggo ang trabaho. Retirement pay = ₱766.77 × 22.5 × 15 = ₱258,784.95. Kailangang 60 hanggang 65 taong gulang at may 5 taon man lang na serbisyo.
